TERMS OF USE

Please read the following important Terms of use (hereinafter referred to as the Agreement) before accessing or using any of the various services (hereinafter referred to as the Services) made available to you (hereinafter referred to as the client) by Kulture fitness through (https://kulturefitness.com).The use of the services from (a unit of Takeoff Technologies Pvt. Ltd.) [Hereafter may referred to as "Kulture fitness"] constitutes agreement to these terms. By accessing or using the Services, you acknowledge that you have carefully read and understood whatever has been listed, and you agree to be bound by these Terms.

PRINCIPAL TERMS

  1. This agreement commences once you have indicated your acceptance in the Declaration section of the web sign up process.
  2. You will be entitled to all the rights and privileges exercisable for the Type of Membership chosen.
  3. You cannot transfer this agreement to anyone else.
  4. Your membership will automatically end at the end of the initial term unless you choose to renew it.
  5. We may periodically change the Terms and the Site without notice, and you are responsible for checking these Terms periodically for revisions.
  6. Your access to use of the Website and the Services will be solely at the discretion of Kulture Fitness.
  7. Kulture Fitness assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect User’s equipment on account of User’s access to, use of, or browsing the Website or the downloading of any material, data, text, images, video content, or audio content from the Website. If a User is dissatisfied with the Website, User’s sole remedy is to discontinue using the Website.

MISCELLANEOUS TERMS

  1. Members must be 15years or older to sign-up. 
  2. You agree to comply with the Rules of Membership which are displayed prominently in the Partner’s Studio and relate to opening hours, use of facilities and your conduct. We may makereasonable changes to these Rules at any time.
  3. There may be occasions where we have to close all, or part of, the Partner Studio of which you are a member. We will do our best to let you know of such closures in advance of them taking place, unless the problem is urgent or an emergency. We will use all commercially reasonable endeavors to ensure that such closures are outside of peak visiting hours and are kept to a minimum, in both duration and frequency. You will not be entitled to a refund of part of, or all of, your membership fees in such circumstances.
  4. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by any event that is outside of our reasonable control.
  5. Your membership applies to you personally: you cannot lend, assign or transfer it to another person.
  6. Smoking, including the use of e-cigarettes is not allowed in any part of the partners. Possession of alcohol, narcotics or other mood-altering substances is not permitted, neither is the use of a Partner while under the influence of any of these substances.
  7. We may refuse admission to or ask you to leave the relevant Partner studio if Kulture Fitness reasonably believes that you have broken any section of this agreement or partner’s rules and regulations. No refund will be given if you are asked to leave a Partner in such circumstances.
  8. Members must secure their personal belongings on their person or place and secure them in the lockers provided by our some of the Partners all times while using a Partner’s facilities. Your property is left in these lockers entirely at your own risk.

PAYMENT OF FEES

  1. By completing the online sign-up form and agreeing to be bound by these Terms and Conditions; you agree to pay Kulture Fitness membership fees on time.
  2. The Joining Fee and your first month’s Membership fees are due immediately and will be taken as soon as you complete your online membership and are non-refundable under any circumstances. Your second and subsequent payment will be collected from you on the monthly anniversary of the date of your membership application.
  3. From time to time we may need to increase or decrease the price of membership and you can see this difference by visiting the website https://www.kulturefitness.com.
  4. All payments made are non-refundable under any circumstances.

FACILITIES AND SERVICES

  1. In order to gain access to our Partner Gyms/studio you must provide your Mobile Number in order to access Facilities every time you visit.
  2. If you want to take any extra facility in any of our partner studio which is not included in kulture fitness membership like spa, sauna or any other paid facility then you have to pay extra for that facility to that particular partner. Kulture fitness is not responsible for providing any of these facilities.
  3. You must not share your Mobile Number or permit its use by anybody else.
  4. You can visit only one Partner’s Studio/day and only one time.
  5. You acknowledge that to provide the highest standards of facilities, each Partner may need to close certain or all facilities temporarily for decorating, cleaning, essential repairs or maintenance of equipment and special events, that this may disrupt the provision of services to you and agree that such disruption shall not amount to a breach of this agreement by us.

DATA COLLECTION

  1. We will use the information you provide to us to:
  •  Provide you membership services
  •  Process your membership payment
  •  Inform you about similar products or services that we, or selected third parties provide, but you may stop receiving these at any time by contacting us at helpdesk@kulturefitness.com.
  1. We will not give your personal data to any third party except our partners/service providers.
  2. We reserve the right to take photographs of our facilities (which may include you, provided your inclusion is incidental) for press and promotional purposes.
  3. In the event you change or deactivate your mobile telephone number, you will update your account information on Kulture Fitness within 48 hours to ensure that your messages are not sent to the person who acquires your old number.
  4. Your Records is only created after you have signed up and explicitly accepted these Terms.
  5. You may lose your “User created” record, if the data is not synced with the server.

You can see the Information related to your Payment Record and Account by visiting our website https://kulturefitness.com and logging in into your particular account.

APPLICABLE LAW AND DISPUTE SETTLEMENT

This Agreement shall be governed by and interpreted and enforced in accordance with the laws of the Country, State and City where Company is incorporated, applicable therein without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in a court in the city, state, country where Company is incorporated..
